When can you make a claim?

Our employment solicitors will help you decide whether or not your case can be brought before the employment tribunal.
There are three main reasons to make a claim against your employer:
- Unfair dismissal
- Workplace discrimination
- Unfair pay deductions

In most cases, you will have you make your claim within three months of your dismissal or the problem’s occurrence.

Contact Us

"I would like to thank Jayne Harrison for her professionalism, patience, honesty and transparency when dealing with my employment tribunal case. From our first telephone conversation, Jayne made me feel confident about my case and she prepared me for what was going to come soon. Her knowledge, experience and confidence... was exceptional and she managed to negotiate a higher settlement agreement with respondent than I even expected. The whole experience was an emotional rollercoaster at the times but Jayne's commitment, hard work, support, advise and expertise helped me to stay calm and prepare my case to the highest level. I would recommend her to everyone that is preparing their own employment tribunal case as she is the best possible solicitor you can find.”

ACAS early conciliation

Before you can bring a claim to the employment tribunal, you must first notify Acas (the Advisory, Conciliation and Arbitration Service) that you intend to make a claim. They will then give you the chance to end the dispute through their free ‘Early Conciliation’ service. If you and your employer are unable to reach an agreement, Acas will give you an early conciliation certificate, which you will need when making a claim to the tribunal.

Making a claim

Claims can be submitted online and must be made within one month of receiving the early conciliation certificate from Acas. Employment tribunal solicitors will be able to help you review your claim and ensure that it is submitted correctly.

Paying for a Solicitor

The general rule in an employment tribunal is that each side pays their own legal fees regardless of whether they win or lose. There are exceptions but cost orders are rare.

It is possible that your trade union will cover your costs. If you are worried about legal fees then talk things through with us using our free no-obligation enquiry.

You may already have insurance cover for legal costs. Legal expenses insurance is often tagged on to home insurance. If you do not have insurance cover, we may be prepared to take claims on a ‘no-win-no-fee’ basis.

The first step of the process is to get in touch with our employment tribunal solicitors for a free consultation. After this conversation, you will be able to decide how you would like to proceed. Use the form at the top of the page to get in touch with us.
