Under the Sexual Offences Act 2003, voyeurism is a serious criminal offence involving observing or recording someone engaged in a private act, such as using the toilet, undressing, or engaging in sexual activity, without their consent, and for the purpose of sexual gratification. It can carry significant consequences, including imprisonment and placement on the sex offenders register.

Mr. A was accused of using his mobile phone to record members of the public by placing the device beneath a cubicle partition. Upon instruction, Jacqui Callan advised him on the law surrounding voyeurism, possible defences, police procedure, and the pre-charge engagement process.

Pre-charge engagement is a voluntary exchange between investigators and defence solicitors before any charging decision is made. It allows for the clarification of issues, sharing of evidence, and proposing further lines of enquiry, potentially avoiding unnecessary prosecution.

During his police interview, Mr. A provided his account of events, maintaining that he had not recorded any members of the public. He explained that he was composing and sending an email at the time of the alleged incident.

Throughout the investigation, Chloe Salt maintained regular contact with the police to ensure Mr. A was kept fully informed of any developments. His electronic devices were examined using police triage software, which included scans for any indicative searches or inappropriate material.

The investigating officer subsequently submitted the case file to their Sergeant for review. Following this review, it was determined that there was insufficient evidence to proceed. As a result, the case was closed with a decision of No Further Action (NFA).
