Public Inquiries

There are a number of reasons that a Public Inquiry could be called before the Traffic Commissioner. These include considerations in granting an Operators License application, disciplinary action and assessment of financial standing of Operators.

In the event that you are called to appear in an inquiry, it is essential that you get in touch with one of our expert transport solicitors for legal advice as soon as you can.

Operator's license applications

Richard Nelson LLP’s transport solicitors are able to advise you in respect of applications for new Operators Licenses and applications to make amendments to an existing licence. If these applications are not put together correctly there is the possibility that they will be refused or that a Public Inquiry will be called. DVSA

There will be circumstances where your vehicles are stopped and various infringements have been found either in respect of the vehicle, the load carried, or possibly in respect of the tachographs held by the driver. Sometimes these infringements are dealt with by way of prohibition or fixed penalty notice but at other times, they can lead to prosecution in the Courts by the DVSA.

Driver conduct hearings

A Traffic Commissioner can call a driver to a Driver Conduct Hearing in order to consider taking regulatory action against their vocational licence, often as a result of some kind of offence or relevant conviction committed by the driver. These hearings can also be called to evaluate a candidate’s suitability for a vocational licence.
