Will I have to sell my house if we get divorced?

It is normal to worry about there being a change in your financial circumstances if you get divorced. I am often asked, “if I get divorced, will I have to sell my house?”.

The court always has to consider the outcome based on the individual circumstances of each case, and the party’s needs moving forward with the children’s needs being the court’s first consideration.

If it would be affordable for one party to keep the family home, particularly where children are involved, that may be the sensible outcome.

However, if it isn’t affordable as the staying party is unable to pay all the running costs of the house or there isn’t sufficient capital to enable the other party to re-house, then there may be no other option but for the house to be sold.
