Do I need a financial order?
The simple answer is yes. If you divorce and you do not sever your financial ties formally by obtaining a sealed Financial Consent Order from the Court, your financial claims against one another remain open.
Even if neither party wishes to claim against the other’s assets, it is strongly advised to obtain a Clean Break Dismissal Order. This ensures that the other party cannot make a financial claim against you in the future. As an example, you would need to protect yourself should you win the lottery or inherit any monies in the future, which you wouldn’t want your former spouse to be able to make a claim against.
