Does the length of marriage have an impact on a divorce settlement?

The longer a couple has been together, the more likely their finances have been mixed and grown over a longer period of time. The Court is likely to consider that financial decisions have been made together by parties who have been married for 15+ years, in comparison to newlyweds. The Court is likely to consider that decisions (even if made by just one party) have been accepted by the other party if they have been together for 15 years and over.

That being said, each case is determined on its own individual facts, with housing and income needs having to be considered by the Court. The needs of any children are always the Court’s first consideration.
