Maria Anthony a solicitor in our Professional Disciplinary team, was instructed to advice a Headteacher who had been referred to the Teaching Regulation Agency (TRA) following allegations regarding professional interactions and safeguarding issues relating to a teachers Whats App group.

Background:

The staff WhatsApp group which was limited to senior staff at the school had been set up before our client had joined the school. He was introduced to it by senior staff when he first joined and was essentially encouraged to make the chats less boring. The WhatsApp chats included a lot of socialisation and what could be described as adult humour.

A post was sent to the Whats App group by another teacher who suggested that they had accidentally shown a class pornographic content.

The allegations raised against the Headteacher included that he posted and encouraged colleagues to post inappropriate sexual and offensive content; his conduct was sexually motivated; he had failed to take appropriate action to safeguard pupils. These allegations were of a serious nature and had the potential to result in our client being referred to the TRA’s Professional Conduct Panel.

Our Approach:

The case involved a substantial volume of evidence and required careful consideration of the client’s actions, responsibilities and decision-making in the context of the allegations. The client instructed Maria to review the allegations, supporting evidence and relevant correspondence from the TRA in order to advise on and prepare the most appropriate response on their behalf. Having undertaken a detailed analysis of the material, Maria identified a number of factual inaccuracies, unsupported assertions and important contextual matters that had not been properly considered. She took full instructions from the client during a conference and worked closely with them to establish a clear chronology of events.

A comprehensive 18-page set of written representations was then prepared on the client’s behalf, along with appropriate supporting documents gathered. The client was encouraged to reflect upon the concerns raised and, where appropriate, acknowledge aspects of the allegations. The representations addressed each allegation individually, examined the evidence relied upon, and provided detailed submissions regarding the client’s actions, responsibilities and knowledge at the relevant times.

Particular attention was given to the client’s role and understanding of the matters under consideration, and to whether the available evidence supported the seriousness of the allegations advanced by the TRA. The representations also highlighted relevant mitigating factors, the client’s previous professional record, and the absence of evidence demonstrating misconduct of a nature warranting further regulatory action.

The resulting representations provided a clear, structured and persuasive response, enabling the TRA to fully understand the client’s position and consider the evidence in its proper context.

Outcome:

Following consideration of the written representations and supporting evidence submitted by Maria, the TRA concluded that no further action should be taken. The matter was closed without referral to a Professional Conduct Panel hearing, allowing the client to continue their professional career without further regulatory proceedings.

The client was relieved to achieve a favourable outcome. The case demonstrated the importance of obtaining specialist advice and ensuring that comprehensive representations are made at the earliest opportunity when responding to serious allegations before the TRA.
