Sentencing Outcome: Community Order for Category A Images Offence
Lily Nutbrown represented a young individual right from instruction at the police investigation stage, through to Magistrates Court and sentence. The individual was charged with possession of indecent images, including a number of Category A images (the most serious Category).
Background:
The client instructed the firm at an early stage of the investigation, following his initial police interview. We provided ongoing support throughout the investigation, including attendance at a further police interview. During the course of enquiries, images were recovered from the client’s phone, and he was subsequently charged.
Our Approach:
Where a client accepts the offence and no defence is available, our focus shifts to preparing strong mitigation to secure the best possible outcome.
In this case, the client presented with significant personal mitigation, including mental health difficulties, social isolation, body image issues, and diagnoses of ADHD and ASD. He had also experienced particular challenges during the COVID period, including difficulties integrating following a move to the UK. It was therefore essential to present a full and coherent picture of his personal circumstances to the court.
We gathered comprehensive mitigation evidence, assisted the client in preparing a letter expressing genuine remorse, and obtained supportive character references from family members.
The Sentencing Guidelines provide a starting point of 12 months’ custody for possession of Category A images, with a range of 26 weeks’ to 3 years’ custody.
Outcome:
At court, through careful and considered submissions, Lily Nutbrown was able to present the client’s mitigation effectively and persuade the court to impose a Community Order. This was a positive outcome, avoiding immediate custody and resulting in a shorter period subject to notification requirements.
