Ginis Padure

Ginis is a civil and commercial litigation solicitor.

He acts for businesses, owners and directors, and for private individuals, in disputes before the County Court and the High Court, including the Business and Property Courts. He has worked in dispute resolution since 2014, and his caseload has ranged from straightforward claims through to technically complex six- and seven-figure disputes, including cross-border litigation. Matters stay with him from the first letter through to conclusion, whether that is a negotiated settlement, a judgment at trial or the enforcement of one. In the great majority of the matters he has conducted, Ginis has met or surpassed his clients’ objectives.

Much of his work is aimed at resolving disputes without the need for a trial, through strategic negotiation and mediation, and in construction matters through pre-action meetings and adjudication. His preparation is directed at building the leverage that makes a favourable settlement achievable, rather than arriving at a mediation and hoping for one. Where a case can be brought to an end on proper terms, he does so. Where it cannot, he litigates firmly and sees it through. He acts for claimants and defendants alike.

Ginis advises and represents clients in the following areas:

Contractual and commercial — misrepresentation, breach of contract, supply and services agreements, warranties and guarantees, debt recovery, and insurance disputes over cover and indemnity.

Company and insolvency — shareholder and director disputes including deadlock, directors’ duties, statutory demands, winding-up petitions, and claims against directors of insolvent companies in their personal capacity, including under the Companies Act and for misfeasance.

Civil fraud and equitable claims — fraudulent misrepresentation, unlawful means conspiracy, dishonest assistance, and claims arising where money or property is held on trust.

Construction and engineering — performance and payment claims, variations and defects, adjudication and its enforcement, and proceedings in the Technology and Construction Court.

Departing employees and directors — restrictive covenants, misuse of confidential information and client lists, and unlawful competition.

Landlords, tenants and landowners — possession, rent arrears, disrepair, trespass, deposits and other tenancy breaches, HMO issues, together with boundary disputes.

Across these areas, he brings and resists applications to set aside or vary judgments and orders, including those affecting frozen accounts and assets, for specific disclosure, and for injunctive relief. He also acts in detailed assessment proceedings.
