What is indecent exposure?

Indecent exposure is sometimes referred to as ‘flashing’. However, the legal definition is found in section 66 of the Sexual Offences Act 2003, which makes it a criminal offence for a person to intentionally expose their genitals, where there is an intention that someone will see them and cause alarm or distress.

Both men and women can commit indecent exposure, which can take place in public or private, although it usually happens in public.

What sentences are given for indecent exposure?

If an indecent exposure case ends up with a conviction or a guilty plea, it is commonly dealt with by way of a fine or community order. However, it is possible to be sent to prison for up to 2 years, depending on the exact circumstances of your case.  In addition is the possibility of being required to sign the Sex Offenders Register. The stakes are therefore high, making it essential to obtain specialist criminal defence advice and representation.
