BACP Lawyers (British Association for Counselling and Psychotherapy)
We defend and represent BACP registrants who are facing a fitness to practise investigation. Our Expert Lawyers can support and assist you during the BACP’s disciplinary process.

Legal Representation for BACP Registrants
BACP is a voluntary regulator, meaning membership and registration are not legally required for practising as a counsellor or psychotherapist in the UK. If you are on the BACP’s register, you must adhere to their standards and ethical framework.
BACP investigates complaints related to fitness to practise. The following relevant factors constitute fitness to practise:
- Skills, knowledge, and experience
- Health and Wellbeing
- Good character
- Working with competence
- Client safety
We represent BACP registrants at every stage of the fitness to practise process, including the Preliminary Investigation, Investigation and Assessment, a Panel Hearing and a Final Hearing. We also represent BACP registrants with Interim Order Hearings.
Contact UsPreliminary Assessment
During the Preliminary Assessment stage, the BACP gather information and part of this will include seeking a response from you on the complaint received. It is worth speaking to one of our expert Lawyers before responding to an invitation for comment by the BACP. After the preliminary assessment, the matter may be closed or referred to Investigation and Assessment.
Investigation and Assessment
The BACP will conduct a more in-depth review of the evidence at this stage.
Panel Hearing
If the Investigation and Assessment Committee finds sufficient evidence of a potential breach of professional standards, the case may be referred to a Practice Review Hearing. Panel hearing outcomes include:
-No Further Action
-Advice or Warning
-Accepted Disposal
-Referral to a Final Hearing
Final Hearing
At the Final Hearing, the Panel will hear evidence from both you and the complainant.
Interim Order Hearing
At any stage of the fitness to practise process, the Interim Orders Committee can impose an Interim Order, whilst BACP investigate the complaint or concern raised against you.
We understand the impact an investigation into your fitness to practise will have on you, both professionally and personally. Our expert BACP Lawyers can work with you, offer you expert legal advice and assist you during this process.
