Legal Representation for Psychotherapists and Psychotherapeutic Counsellors

While registration with UKCP is voluntary, if you are on their register, you have agreed to abide by UKCP’s rules and guidelines. If you receive a concern from the UKCP about your professional or clinical conduct, or from your conduct outside of professional practice, we can advise and assist you with the various stages of the UKCP’s fitness to practise process.

A concern about a registrant’s fitness to practise can be raised by anyone, including clients, colleagues, or the public.

We have a wealth of experience of representing UKCP registrants at every stage of the fitness to practise process including the initial stage, the investigation, case examination, and at the Adjudication Panel hearing stage. We also specialise in defending UKCP registrants at Interim Order hearings.

What are the process of UKCP investigation?

Initial Stage
At this stage the UKCP will assess the concern to determine whether it meets the threshold for investigation.
-Investigation
The investigation stage will involve the UKCP gathering evidence.
You will be given 28 days to respond to allegations made against you.

Case Examination
A Case Examiner will decide whether there is a case to answer.

Adjudication Panel
The Panel will consider the evidence from both you and the complainant and make a decision.
The panel can decide that your fitness to practise is not impaired, or they may impose sanctions, such as a warning, conditions on practice, suspension, or striking off from the register.

Appeals
You will have the right to Appeal the Panel’s decision if you disagree with it.

Interim Order Hearings
At any stage of the fitness to practise process, the Interim Orders Committee can impose an Interim Order, whilst the UKCP investigates the complaint or concern raised against you.

We have extensive experience of representing UKCP registrants at Interim Order Hearings and Adjudication Panel Hearings as well as preparing persuasively written submissions responding to the allegations made against you.

We understand the impact an investigation into your fitness to practise will have on you, both professionally and personally. Our expert UKCP Lawyers can work with you, offer you expert legal advice and assist you during this process.
