There have been significant changes to the UK Asylum and Immigration system since the Nationality and Borders Act 2022 which have recently come into force.

This may be the case if you have lodged an application and it has been refused or your current leave has expired, and you are an overstayer or if you have never secured leave to remain in the UK. Deportation Appeals

You can challenge a decision of deportation if you have Asylum or Human rights grounds supporting your leave in the UK.

Immigration Bail Applications

Applicants can apply for Immigration Bail if the Home Office is holding them on immigration matters at an immigration removal centre, detention centre or prison.

By submitting a strong application for Immigration Bail, the applicant can be released from immigration detention and will be subject to at least one bail condition.

Applications To Regularise Leave Outside The Rules (LOTR)

You can apply for leave outside of the rules on the basis of compelling compassionate grounds (other than family and private life, medical, asylum or protection grounds).

Richard Nelson’s deportation team can assist with the following asylum matters.

Asylum Applications

An asylum application can be lodged for international protection. This is for individuals who have left their country of origin and are unable to return because of a fear of persecution.

The persecution must be based on the applicant’s race, religion, nationality, political opinion or anything else that puts them at risk because of a social, cultural, religious or political situation in the country, namely gender, gender identity or sexual orientation. The applicant must have failed to secure protection from the authorities in their own country.

Successful applicants would be granted refugee status in the UK.

Stateless Applications

A stateless person can apply to regularise leave in the UK if they are not recognised as a citizen of any country and they are unable to live permanently in any other country.

The applicant must be in the UK to apply.

However, if they cannot return to another country due to fear of persecution there, they must initially claim asylum and await a decision. If the asylum or human rights application is refused the applicant can apply to remain as a stateless person and the application will be considered on its merits.
