When can you make a claim?
Our employment solicitors will help you decide whether or not your case can be brought before the employment tribunal.
There are three main reasons to make a claim against your employer:
- Unfair dismissal
- Workplace discrimination
- Unfair pay deductions
In most cases, you will have you make your claim within three months of your dismissal or the problem’s occurrence.
Acas early conciliation
Before you can bring a claim to the employment tribunal, you must first notify Acas (the Advisory, Conciliation and Arbitration Service) that you intend to make a claim. They will then give you the chance to end the dispute through their free ‘Early Conciliation’ service. If you and your employer are unable to reach an agreement, Acas will give you an early conciliation certificate, which you will need when making a claim to the tribunal.
Making a claim
Claims can be submitted online and must be made within one month of receiving the early conciliation certificate from Acas. Employment tribunal solicitors will be able to help you review your claim and ensure that it is submitted correctly.
Paying for a solicitor
The general rule in an employment tribunal is that each side pays their own legal fees regardless of whether they win or lose. There are exceptions but cost orders are rare.
